The Digital Privacy Act 2015:
How the PIPEDA Amendments Affect the Staffing Industry in Canada

Bill S-4, the Digital Privacy Act, has received Royal Assent. The bill was passed by the Senate last summer, and passed third reading in the House of Commons on June 18th, 2015. Most of these long overdue Personal Information Protection and Electronic Documents Act (PIPEDA) amendments are already in force. Those staffing firms to whom PIPEDA applies, being those who operate in multiple provinces or in provinces such as Ontario that do not have their own private sector privacy laws, should be aware of key changes to the law. These include new consent exemptions for certain disclosures of personal information; exemptions for business transactions and work product information;  guidance on what constitutes valid consent; breach notification and reporting obligations; and more.
